Terms & Conditions

Our goal is to provide a safe, secure, and user-friendly experience for all our visitors. These terms and conditions are designed to ensure that everyone can use our services without any issues. We encourage you to review this page periodically, as we may update the terms from time to time to reflect changes in our practices or to comply with legal requirements.

GENERAL

  • Whalebill Treks Africa Limited (The Company) organizes safaris across eastern African region.

  • Please take some time to read our terms and conditions as they will form the basics of our commitment and respective obligations.

  • In these terms and conditions “we” and “us” means Whalebill Treks Africa Ltd and “you” means all persons named on the booking including anyone added or substituted later. Terms are amended from time to time as the need may arise and the terms at the time of booking apply.

  • Service delivery in Africa may not be as developed as back home — for example roads, medical, safety measures, and security — so kindly bear with us.

  • Please note that the laws of the country you are visiting in which services are provided apply and not those of your home country.

OUR TERMS & CONDITIONS

1. Booking and Payment

  • A 50% deposit is required to confirm a booking.

  • Full payment must be received at least 30 days before the tour start date.

  • Payments can be made via bank transfer or credit card (fees may apply).

2. Cancellations and Refunds

  • More than 60 days before tour – 80% refund of the deposit

  • 30–59 days before tour – 50% refund of the deposit

  • Less than 30 days before tour – No refund

  • Gorilla permits are non-refundable once purchased

3. Cancellations By Us.

  • Occasionally, we shall have to cancel confirmed bookings. We always endeavour to avoid cancellations, but we must reserve the rights to do so. We shall not cancel your confirmed booking less than 45 days before departure unless we are forced to do so because of unusual and unforeseeable circumstances beyond our control the consequences of which we would have avoided even with due care.   • If we cancel your holiday except where you have failed to make payment or because of force majeure, we shall offer you a choice of purchasing an alternative holiday from us of a similar standard to that originally booked if available. If the chosen alternative is less expensive than the original holiday, we shall refund the difference and if it is more expensive than the original holiday, you will be requested to pay the difference.

  • Alternatively, you are entitled to a full refund of all monies you have paid except gorilla permits which can only be refunded if the refund has been made available to us.

  • Except if we cancel for reasons other than those mentioned in this clause, we shall have no further liability to you. We regret that we cannot pay expenses, costs and loses incurred because of any cancellation.

  • We reserve the right without prior notice, to terminate the holiday of any person in your party if, in our opinion, or any other person in authority, if the person concerned behaves in such a way to cause or be likely to cause danger, annoyance or distress to any third party or damage to property.

  • In this situation the person(s) concerned will be required to leave the accommodation or other service immediately. We shall have no further responsibility towards such a person(s). No refunds will be made, and we shall not pay the expenses or costs incurred because of the termination.

4. Cancellation By You

  • Should you or any member of your party be forced to cancel, you should advise us in writing. A cancellation is not effective until we receive a copy of your written notice. To cover our estimated loss caused by the cancellation and as we may be unable to resell your holiday, cancellation fees excluding insurance will be levied per person as follows.

5. Tour Alterations

  • Whalebill Treks Africa reserves the right to change itineraries due to weather, park regulations, safety, or unforeseen circumstances.

    • If a scheduled activity is cancelled due to reasons beyond our control, we will offer an alternative or partial refund.

6. Client Responsibility

  • Clients must ensure they are medically fit for activities booked.

  • Valid travel insurance covering health, accidents, and trip cancellation is required.

  • Clients must follow all safety guidelines provided by guides and park authorities.

7. Health and Safety

  • Clients showing symptoms of illness (including flu, fever, or contagious conditions) may be restricted from joining certain activities.

  • We follow Uganda Wildlife Authority (UWA) and Ministry of Health regulations on health and hygiene.

8. Liability

  • Whalebill Treks Africa is not liable for injury, death, loss, or damage arising from wildlife encounters, natural hazards, or third-party services.

  • We take all reasonable steps to ensure safety, but participation is at the client’s risk.

9. Compensation Policy

a. Missed Activities or Services
If Whalebill Treks Africa fails to deliver a booked service due to internal fault (e.g., vehicle failure, guide no-show), clients will receive:

  • A suitable replacement activity or

  • Partial refund equivalent to the value of the missed service

b. Delays or Disruptions
If a delay caused by Whalebill Treks Africa causes a missed connection, permit, or booking, we will:

  • Cover reasonable expenses for replacement services

  • Provide written confirmation for travel insurance claims

c. Wildlife Sightings
Gorilla or wildlife sightings are not guaranteed, and no compensation is offered if wildlife is not seen during treks or drives.

10. Dispute Resolution

  • Any disputes will be handled through negotiation.

  • If unresolved, the matter will be referred to a mediator in Uganda.

  • The laws of Uganda apply.

11. Accuracy of Information

The descriptions, information, and opinions given by us in respect to national parks, animals, sightings, accommodation, itineraries, gorilla permits, and security are given in good faith based on the last information available to us. Every care has been taken to ensure the accuracy of the information provided. We cannot accept any liability for any errors or omissions caused by matters beyond our control.

12. Accommodation

Unless a client requests a specific accommodation, we reserve or recommend the best facility reasonably priced, charming hotels/lodges with private bath, hot water, good service, and value. Prices are based on two persons sharing a double or twin room. We reserve the right to substitute equivalent or superior hotels. We make every effort to arrange shared accommodation for single travellers when requested. If the request cannot be honoured, the quoted single supplement will apply.

13. Jurisdiction

  • The principal company is incorporated in the Republic of Uganda, and it operates under the laws of Uganda.

14. Photography on Tour

  • We reserve the right to take photographic images of individual participants to use for commercial promotion of our safaris. Tour members who prefer that their image not be used are asked to identify themselves to their tour guide at the start of the tour or send us an email to that effect.

15. Safari Terms

  • Prices include Airport Transfers, accommodation, meals as stated, the services of an English-speaking driver/guide, and a 4X4 safari vehicle; portage of two items of baggage per person, park entry fees, gorilla and chimpanzee permits where applicable.

  • Prices exclude all items of a personal nature such as entry visas, tips, telephone calls, laundry, gifts, airport taxes and all drinks not provided with accommodation. We offer 1.5 liters of mineral water per person daily. The company reserves the right to vary the safari services agreed with the client in the event of unforeseen circumstances such as road closures, bad weather, problems with national parks or hotels, or security considerations. In such cases, alternative arrangements will be made as circumstances permit.

16. Transportation

  • Every person gets a window seat in the vehicle. We ensure vehicles are roadworthy, but no liability is accepted for breakdown, damage, or delay.

  • Guides follow a strict code of conduct. If the driver is not disciplined, report immediately to our Kampala office.

  • In case of breakdown, we will either replace or repair the vehicle depending on the severity.
